The terms, conditions and terms of liability under which the tours operate are detailed below.
The payment of the deposit, or tour price, represents acceptance by the purchaser of the terms and conditions.
Terms and Conditions
1. The tours are organised and operated by Kayak Paradise New Zealand Limited (“the Company”).
2. A minimum number of bookings are required to operate a tour and also to ensure an enjoyable atmosphere. Where sufficient numbers cannot be achieved, the Company reserves the right to cancel a scheduled departure.
3. The decision to operate the tour is usually made 45 days prior to the scheduled tour departure date. However, in some instances, this decision may not be available until 30 days prior to the departure date.
4. Where a tour is cancelled prior to the departure date, according to clauses 2 or 3 above, we shall endeavour to offer the nearest possible alternative tour (subject to a refund or payment to cover any tour price difference) or, if this is not acceptable refund your monies in full.
5. The Company reserves the right to alter or change the accommodation, carriers or other service providers at any time for any reason.
6. The Company reserves the right to cancel or alter the itinerary and/or tour without notice as may be found necessary for any reason whatsoever including, but not limited to:
a. Road or traffic conditions; b. weather conditions or other acts of God; c. non-performance of suppliers; d. industrial action; e. acts of war; f. acts of terrorism; g. political instability; and h. operational conditions and requirements.
7. In the event of cancellation of a tour or a change to the tour itinerary, the Company will endeavour to supply comparable services, accommodation and itineraries. All additional expenses incurred as a result of any delays, cancellations or alterations will be the sole responsibility of the client.
8. The kayaking component of the tour is subject to weather conditions and will be assessed on a daily basis. The decision of the tour guide(s) to proceed or cancel with a kayaking component is final. In most cases an alternative hike is available.
9. Any special client requirements must be notified to the Company at the time of booking. No client will be permitted to embark or continue on the tour while their mental or physical condition is, in the opinion of any Company representative, such as to render them incapable of caring for themselves, or whereby they become objectionable to other clients, or they become a hazard to themselves or other clients. The Company will not be responsible for expenses resulting in any such person being precluded from starting or completing the tour for any such reason.
10. The Company does not guarantee the exact arrival and departure times for carriers and operators used by the Company in the tour. The Company will not be liable for failure to make connections with any other services and/or missed tour inclusions.
11. The Company reserves the right to cancel any ticket or booking or to refuse to carry any client where payments have not been received by the Company within the times specified. It is a condition of carriage that a client has paid all the tour monies at least 45 days prior to departure of the tour.
12. In the event of industrial action affecting air, rail, cruise or tour related transportation the Company will make every effort to contact the client and advise alternative arrangements. However, if contact is not made, clients should phone +64 7 849 5013 or +64 274 898 734
13. The tour will include activities such as kayaking, trekking, climbing, exploring, swimming and snorkelling. The client unreservedly accepts that these activities involve varying degrees of risk.
14. Due to Government legislation and the Company’s policy, smoking is not permitted inside tourist coaches; however, frequent stops provide opportunity for those who desire to smoke.
15. If, after the commencement of a tour, a client withdraws or is withdrawn, for whatever reason, no refund shall be made.
16. If, during a tour, a client is absent from a part or parts of a tour, no refund shall be made available for any such absence. This includes, but is not limited to, missed meals, sightseeing, or tour activities.
17. Included in the Fare:
Your fare includes: a. all coach travel; b. accommodation on a share twin basis; c. services of a tour guide and coach driver; d. daily continental breakfast; e. dinners as indicated in the itinerary; f. sightseeing and admissions as indicated in the itinerary; g. the use of kayaks and equipment during guided kayak trips; and h. services of kayak guides.
18. Not included in the Fare:
Airfares, meals not specified in the itinerary, drinks, laundry, and items of personal nature.
Please note that this is a ‘Coach Content Only’ tour and does not include transfers to departure/return points nor additional pre or post tour accommodation. However, we are happy to arrange that for you at extra costs.
19. Prices and Concessions:
Prices are quoted in New Zealand currency and include Goods and Services Tax. Additional fuel surcharges may apply. Group concessions for ten or more people are available.
20. Single Rooms:
Single rooms are available upon request and a supplement is payable at the time of booking. However, at peak times rooms are in great demand and it may not always be possible to secure a single room at every accommodation. Please enquire at the time of booking.
21. Booking and Conditions:
To confirm your reservation a deposit of NZ$200 is required. Reservations will be held for 7 days only without deposit. Balance of payment for your holiday is to be paid 45 days prior to departure. The Company reserves the right to accept waitlist clients in place of applicants failing to finalise within the prescribed time
22. Cancellations and Amendments:
Cancellation fees will be levied relative to the amount of notice given:
Days Notice Given:
45 days or more: Loss of Deposit
14 - 44 days: Loss of 20% of fare plus loss of Deposit
6 - 13 days: Loss of 50% of fare plus loss of Deposit
1 – 5 days: Loss of 100% of fare Plus loss of Deposit Day of Departure: Loss of 100% of fare Plus loss of Deposit
Cancellations must be made in writing and any notice is not effective until received by the Company. Days of notice commence from the day notice is received (during office hours not being weekend or public holiday) by the Company.
23. Tour Participation:
This tour is designed for adults. For safety reasons, especially on the water, we cannot accept children less than 16 years of age. Children between 16 and 18 years of age must be accompanied by an adult.
Our tours are limited to 16 participants to ensure a personalised service as well as safety on the water. The Company endeavours a ratio of 1 guide: 8 participants on the water.
24. Pre-existing Medical Conditions:
Every client must advise the Company of any pre-existing medical condition and/or disability. Please be aware that the Company can not give special assistance. The Company reserves the right to refuse to carry anyone if it is believed that the individual cannot cope with the requirements of coach tour travel and/or kayaking trips and who may require services and facilities that cannot be guaranteed to be available. You agree not to hold Kayak Paradise New Zealand Ltd responsible for any reasonable decision made by the Company, representative or agent of the Company, or any service provider to refuse to carry you, or to provide any facilities or accommodation to you or to provide any service to you. 25. Travel Insurance:
Baggage is carried entirely at the ‘owner’s risk’ during the tour and we STRONGLY RECOMMEND that you take out PRIVATE TRAVEL INSURANCE. We also advise you take out travel insurance to cover any unforeseen circumstances such as cancellation and curtailment expenses.
26. Luggage Allowance:
Clients are entitled to carry one suitcase or bag per person. The suitcase or bag is not to exceed 20kg. In addition, a travel bag (airline bag size) for personal items can be carried on-board the coach. All luggage and personal effects are at all times and in all circumstances carried at the risk of the client. Luggage insurance is recommended. 27. Please be advised that every client will have to sign a copy of the Terms and Conditions prior to tour departure.
